Preliminary Assessment / Observations / Findings:………
1. In terms of Rule-46(1) Procuring Agency is required to ask relevant experience and Annual Turnover not less than equivalent cost of the scheme/project during last five years and Experience of similar nature of works (at least one work of 80% of the estimated cost OR two works of 50% of the estimated cost) executed during last five years is required. In the instant case relevant experience and annual turnover is not as per above provision………
2. “List of works and copy of letter of award of works of equivalent cost or above” asked but it is not clear that how much works to be provided by the participant bidder to determine most advantagous bid…….
3. NIT is uploaded on EPAD accordingly the interested bidders are required to submit & open their bid through the EPAD-System, however, NIT envisaged that bid will be submitted and opened in the office of Procuring Agency, which is against the standard of electronic bid through EPAD. Procuring agency is required to rectify the infirmity at the earliest………….
4. Procuring Agency has asked bid security 5% of total bid Amount. Whereas, “The Procuring Agency shall require the bidders to furnish a fixed amount of bid security not exceeding five percent of the estimated value of procurement determined by the procuring agency” as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010(5-13/P-II) dated 25.10.2025. Procuring agency is required to rectify the infirmity………….
5. Procuring Agency has asked affidavit that the firm has not been black listed previously by any executing agency. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition………..
6. Same member of Procurement Committee cannot reflect in Complaint Redressal Committee for the sack of Transparency, which create conflict of interest………
7. Procuring Agency has mentioned the evaluation eligibility / qualification criteria in NIT only. Whereas, in terms of Rule-21(1)(h) read with Rule-21(A), bidding documents must contain a detailed and unambiguous evaluation criteria. The procuring agency is therefore advised to make the evaluation criteria part of the bidding documents.
8. Bidding documents do not contain the Integrity Pact as required under Rule-89 read with Rule-21(1)(n). ………………..
9. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA(https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred…………
10. Procuring Agency is required to rectify/justify the above in timely manner……….
11. PA is required to pay web-hosting charges………
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
