Preliminary Assessment / Observations / Findings:………
1. RFP is uploaded on EPADs accordingly the interested bidders are required to submit their bid through the EPAD-System. In the instant case, neither address of EPAD website is shown in NIT nor procuring agency has mentioned procedure of submission of bid on the EPAD system, however NIT envisaged that bid will be submitted and opened in the office of Procuring Agency, which is against the standard of electronic bid through EPAD. Procuring agency is required to rectify the infirmity………..
2. Condition i.e. “In hard at least one project of similar nature” is not appropriate and may restrict the competition within specific firms /contractors (as it is not necessary for a contractor to wrok in hand) which resulting violation of Rule-44 of SPP Rules 2010. justification/rectification is required………
3. Procuring Agency has asked bid security 2% of total bid Value. Whereas, “The Procuring Agency shall require the bidders to furnish a fixed amount of bid security not exceeding five percent of the estimated value of procurement determined by the procuring agency” as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010(5-13/P-II) dated 25.10.2025. Procuring agency is required to rectify the infirmity………….
4. The RFP documents do not contain amount and manner of payment of bid security and performance security required in terms of Rule-21(1)(d) of SPP Rules, 2010.
5. It seems Composition of CRC is not as per Rule-31(2 because head of Cunsultant Selection Committee (CSC) and Chairman of Complaint Redressal Committee (CRC) is same rank, whereas head of CRC shall be one rank senior to the Head of CSC. PA is required to re-notify the Complaint Redressal Committee in terms of Rule-31(2) of SPP Rules, 2010.
6. Representative of Naqvi Siddiqui Associates has been included as independent professional in CRC. P.A may ensure that said members have not participated in the competition of procurement process (directly/indirectly) otherwise it may conflict of interest and affect the provision of Rule-4 of SPP Rules, 2010…….
7. Procuring Agency is required to upload signed copy of each and every page of RFP Document to enabling the bidder(s) to submit their bids by downloading RFP Document from SPPRA (E-pad) website as defined in the Rule-24 (2) of the SPP Rules, 2010……..
8. Procuring Agency has asked affidavit that firm has never been blacklisted nor any contract rescinded in past. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition.
9. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA(https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred…………
10. Procuring Agency is required to rectify/justify the above in timely manner……….
11. PA is required to pay web-hosting charges………
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
