1) It seems Procuring agency has asked irrelevant category of PEC which may violate provision of Rule-44 of SPP Rules, 2) The condition i.e the contractors/ companies/ firms is not involved in any kind of litigation is required justification under rule-44 of SPP Rules, as appeal in any court of law is right of any citizen of Pakistan. 3) P.A has asked integrity pact signed and stamped in eligibility criteria. It is informed that unsigned integrity to be signed and stamped within procuring Agency and successful bidder at award of contract stage. 4) The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA (https://pprasindh. gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred. 5) In terms of para 2.16 (iv) of the guideline of SPPRA for procurement of works circulated vide SPPRA Notification No. DD(HRF&CB)/ SPPRA/22-23/0942 dated 10th April, 2023; according to which relevant experience of similar nature of works ( at least one work of 80% of the estimated cost OR two works of 50% of the estimated cost) executed during the last five years, in the instant case P. A has not asked for any relevant experience of any years only, of the time period of the experience has required.. Rectification is required. 6) The Procuring agency has not Uploaded the Procurement Committee Notification as per Rule 07 & CRC Notifications Rule 31 of SPP Rules, which is the violation of SPP Rules, PA is required rectify the same prior to opening of bids. 7) Specific period for experience is not mentioned as per Para 2.16(iv) of Guideline of SPPRA for procurement of works. 8) Procuring Agency has asked Bid Security in the shape of “specific instrument” which is against the provision of Rule-37 of SPP Rules ( Read with policy instructions of SPPRA circulated vide letter No.: MD/SPPR/2028-26 dated 11.05.2026) according to which; P.A has to specify all permissible forms of bids security and bidder(s) have their discretion to submit their bid security any one of form as prescribe in Rule-37(2) of SPP Rules, 2010. 9) Asking Bid security in (%) of bid amount is against the provision of Rule-37 of SPP Rules 2010, amended vide SGA&CD notification dated 25.08.2025 10) Condition about clarification of bids is not in line with Rule-23 of the SPP Rules, 2010. Procuring Agency shall ensure the compliance of above provision.
