Violation Notes
Preliminary Assessment /Observations/Findings:
i. The Procurement Committee consists of more than three members but it does not comprise at least two third of the members from the agencies / departments other than P.A. as per requirement of Rule-7(3) of SPP Rules, 2010. Rectification is required.
ii. The procuring agency has not upload copy of Notification of Complaint Redressal Committee (CRC) in terms of Rule-31. PA is required to uploaded copy of notification of complain redressal committee
iii. The Procuring agency is required to upload newspaper clipping of NIT Published in widely circulated leading daily/ies of English and Urdu language(s) in terms of Rule-17(2) of SPP Rules, 2010 prior to opening of bids
iv. The procuring agency has stipulated a requirement for experience in similar work amounting to 50% of the estimated cost undertaken within the last three years. However, this requirement is not in accordance with SPPRA Notification No. DD(HRF&CB)/SPPRA/22-23/0942, dated April 10, 2023. As per the notification, the bidder must have completed at least one similar project with a minimum cost of 80% of the estimated cost or at least two projects, each with a minimum cost of 50% of the estimated cost, within the last five years. Accordingly, the procuring agency is required to address and rectify this discrepancy.
v. The procuring agency has mentioned requirement of Turnover last 01 Year is more than 2 time to total estimated cost of Quoted items, which is not as per SPPRA notification No. DD(HRF&CB)/SPPRA/22-23/0942, dated April 10, 2023. As per notification, “the requirement of turnover should be mention as average annual turn-over not less than equivalent cost of the scheme/project during last five years”.
vi. The procuring agency is required to upload signed copy of bidding documents, enabling bidders to submit their bids by downloading Bidding documents from SPPRA website in terms of Rule-24(2) of the SPP Rules, 2010.
vii. The procuring agency is required to pay NIT hoisting charges in accordance with this authority’s letter dated: 18-05-2018 available on the following link of the authority’s website http://www.pprasindh.gov.pk/policies/Policy18May2018.pdf.
viii. It is the responsibility of Procuring Agency (PA) to strictly observe the SPP Rules, 2010 in letter and spirit. Violation of any SPP Rule/Act/Instruction will tantamount to mis procurement.
