Subject: EPADS ID NO. 241180951 POSTED ON 20.11.2024 TENDER FOR SUPPLY OF ANIMAL’S FEED.
Please refer to the subject NIT posted on EPADS SPPRA NO. 241180951 and to state that following infirmities have been pointed out during initial assessment;-
i. The procuring agency has posted expired NIT along with Corrigendum No. DGL/E&R/AC/2024/2530 dated 20-11-2024 wherein, change the schedule. The procuring agency is required to upload newspaper clipping of Corrigendum Published in widely circulated leading daily/ies of English, Urdu and Sindhi language(s) and Procuring Agency is required to clarify and justify the delayed hosting of NIT on PPMS website.
ii. The Procuring agency is required to upload the publication of corrigendum in Newspapers in terms of Rule-21(2) of SPP Rules, 2010. Prior to opening of bids.
iii. The Procuring Agency has not uploaded Annual Procurement as required under of Rule-11 of SPP Rules 2010. PA is required uploaded APP.
iv. The Procuring agency is required to upload newspaper clipping of NIT Published in widely circulated three leading daily/ies of Sindhi language(s) in terms of Rule-17(2) of SPP Rules, 2010 prior to opening of bids.
v. The bids are required to be opened within one hour of deadline of submission, whereas, in the instant case the gap between the submission and opening of bids is more than one hour, which is violation of Rule-41(3).
vi. The Procurement Committee consists of more than three members but it does not comprise at least two third of the members from the agencies / departments other than P.A. as per requirement of Rule-7(3) of SPP Rules, 2010. Rectification is required.
vii. The procuring agency has not mentioned the amount of Annual Financial Turnover of last three years in Rupees in mandatory requirements Evaluation eligibility criteria as required in term of Rule 46(1) (a)(ii) of SPP Rules 2010.
viii. PA has mentioned in NIT as 'Single Stage One Envelope' whereas mentioned in bidding documents of NIT reflect procedure of evaluation as 'Single Stage Two Envelope' which create ambiguity and needs timely justification/rectification.
2. In view of above, it is advised to furnish cogent reasons/justification for non-compliance of above referred provision of SPP Rule, 2010. However, due to failure in fulfilment of the mandatory provisions of SPP Rule, 2010, action under Rule-25 of SPP Rules shall be applicable.
3. It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instructions/ orders and procedure in letter and spirit. Violation of any of the SPP Rule/Act/Instruction shall tantamount to Mis-procurement under Rule-32 of SPP Rules, 2010.
