i. The Procuring agency is required to upload newspaper clipping of NIT Published in at least three widely circulated leading dailies of English, Urdu and Sindhi languages in terms of Rule-17(2) of SPP Rules, 2010, prior to opening of bids. ii. Tender fee has been fixed as Rs. 5,000/- which seems excessive because In terms of Rule-20(2), the Procuring Agency is required to ensure that fee charged for bidding document shall not exceed the cost of preparation and printing of the documents. Justification/rectification is required. iii. Date of submission mentioned in the NIT and in the Bid documents is different. Justification / rectification is required prior to opening of bids. iv. Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-pads) website as defined in the Rule-24 (2) of the SPP Rules, 2010. v. As per para 2.16(iv) of SPPRA Regulations for procurement of works circulated vide Notification no.DD (HRF&CB)/SPPRA/22-23/0942 dated 10th April, 2023; relevant experience of similar nature of works (at least one work of 80% of the estimated cost OR two works of 50% of the estimated cost) executed during last five years is required. Whereas, the procuring agency has required experience of three years only, PA is required to rectify the same. vi. The procuring agency has not uploaded notification of Procurement committee, which is required to be uploaded at the earliest/ prior to opening of bids. vii. Procuring agency has not upload Notification of Complaint Redressal Committee on EPAD. Procuring Agency is required to upload Notification of Complaint Redressal Committee in terms of Rule-31 of SPP Rules, 2010. viii. PA is required to signed copy of annual procurement plan on the website in terms of Rule -11of SPP Rules, 2010. ix. PA is required to pay web-hosting charges. Procuring Agency is required to rectify/justify the above infirmities in timely manner. It is the responsibility of Procuring Agency (PA) to strictly observe the SPP Rules, 2010 in letter and spirit. Violation of any of the Rule/Act/Instruction will tantamount to Mis-procurement.
