Preliminary Assessment / Observations / Findings:……… 1). NIT is uploaded on EPAD accordingly the interested bidders are required to submit their bid through the EPAD-System. In the instant case, neither address of EPAD website is shown in NIT nor procuring agency has mentioned procedure of submission of bid on the EPAD system, however NIT envisaged that bid will be submitted and opened in the office of Procuring Agency, which is against the standard of electronic bid through EPAD. Procuring agency is required to rectify the infirmity. 2). The Procuring Agency has uploaded bidding documents of another work i.e. “CONSTRUCTION OF RING BUND TO VILLAGE GHAIBI DERO TALUKA KAMBER (MOST AFFECTED VILLAGE IN 2022)”which is against SPP Rules therefore it cannot be treated as efficient procurement process. Before proceeding further procuring agency is required to upload bidding documents of instant procurement in terms of Rule-21(4) and extend the response time accordingly. 3). Procuring Agency has posted unreadable copy of NIT published in English, Urdu and Sindhi language newspapers. PA is required to upload readable / legible copy of newspaper clipping of NIT published in English, Urdu & Sindhi language newspaper’s in terms of Rule-17(2) of SPP Rules, 2010…………… 4). Procuring Agency has mentioned two different amount for performance security in bidding documents (i.e. 5% and 10% mentioned), which is not as per SPP Rule-39. Procuring Agency is required to mention specific percentage of performance security in terms of Rule-39……….. 5). Procuring Agency has asked affidavit that firm has never been Black Listed from any government. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition…………. 6). The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA (https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred………… 7). Procuring Agency is required to rectify/justify the above in timely manner………. It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
