(1) In terms of Rule-27 of SPP Rule, 2010 the Procuring Agency may engage in Prequalification of bidders in case of contracts of large and complex works and services, turnkey, design and build or management contract, technically complex equipment and work and drugs and services of complex nature. In the instant case the scope mentioned in the Notice of prequalification are of routine nature hence the open competative bidding is applicable. It may be noted that there is restriction upon enlistment or registration of supplier and contractors in terms of Rule-29(4) of SPP Rules. (2) Prequalification document is not as per requirement of Rule-28, hence sprit of pre qualification has not been complied 3) In terms of Rule-27, prequalification adopted to get potential bidder having vast experience and financial capability. In the instant case P.A has asking experience having estimated cost of Rs.0.1 Million only which reflect favoritism. 4) The prequalification does not reflect criteria as mentioned in the prequalification document. (5) Procuring Agency has asked % of bid amount in liue of bid security which conflicting the provision of Rule-37 of SPP Rule, 2010 amended vide SGA&CD notification dated 25.08.2025
