@EPADS-S-250582827 Providing of sanitary Articles for upcoming monsoon season for Sanitation Department TMC Malir Department Name: Town Municipal Committee Malir May 29, 2025, In terms of para 2.16(iv) of guideline of SPPRA for procurement of works circulated vide SPPRA Notification no.DD (HRF&CB)/SPPRA/22-23/0942 dated 10th April, 2023; according to which relevant experience of similar nature of works (at least one work of 80% of the estimated cost OR two works of 50% of the estimated cost) executed during last five years is required. In the instant case period is not mentioned. The Procuring agency is required to upload newspaper clippings of NIT Published in at least three widely circulated leading dailies of English, Urdu and Sindhi languages in terms of Rule-17(1A) read with Rule-17(2), 18 and Authority’s instructions circulated vide No.MD/SPPRA/1-1(GEN)/2021-22/0927 dated 17th March, 2022. Procuring Agency has asked evidence of ownership of machinery in eligibility criteria, whereas a contractor may obtain such machinery on lease/rent basis for project as per clause-2.16(A)(iii) of Regulation for works, therefore, above condition is in conflict with Rule-44 of the SPP Rules, 2010. Rectification is required PA is required to pay web-hosting charges. Procuring Agency is required to rectify/justify the above in timely manner. It may be noted that It is the responsibility of Procuring Agency (PA) to strictly observe the SPP Rules, 2010 in letter and spirit. Violation of any SPP Rule/Act/Instruction will tantamount to mis procurement.
