Preliminary Assessment / Observations / Findings:……… 1. The Procuring Agency has not upload Annual Procurement Plan which is violation of Rule-11 of SPP Rules, 2010. Procuring Agency is required to upload copy of Annual Procurement Plan on E-PADs at the earliest……… 2. In the NIT at para-iv, validity period of bid security is mentioned as “minimum180-days”, whereas it shall be valid till 28-days beyond the expiry of original bid validity period in terms of Rule-37(2). Rectification is required………. 3. In terms of 47(1) single stage one envelope procedure shall be used as standard procedure for procurement of simple and routine nature and where no technical complexity or innovation is involved. However, Procuring Agency (PA) adopted single stage two envelope procedure for routine and simple procurements which is violation of Rule-47(1) &(2) of SPP Rules, 2010. as per amendment notified vide SGA&CD’s notification No: SORI(SGA&CD)2-30/2010 dated 11.8.2021……… 4. PEC registration has been asked whereas as per nature of procurement, it seems not required. Justification under PEC bylaws and Rule-44 of SPP Rules, is required………… 5. "List of machinery and equipments available with documentary evidence of its ownership/rented, and bio data with relevant experience of Engineering & technical staff working with firm” has been asked but it is not clear which type of machinery /equipment and engineering & technically staff is required for the subject work, needs justification as per nature of procurement with assurance of compliance of Rule-44 of SPP Rules……. 6. Bid data sheet envisage two different types of contract i.e. Fixed Price contract and Price adjustment contract. The Procuring Agency is required to choose any one…….. 7. Procuring Agency may ensure the compliance of Rule-31(2)(b)……. 8. Instruction to bidders and Condition of contract is missing. Procuring Agency is advised to posted complete bidding documents as per Rule-21(3) read with Rule-21(1) of SPP Rules……….. 9. Procuring Agency has asked affidavit that the firm is not currently blacklisted. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition……….. 10. Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-PADS) website as defined in the Rule-24 (2) of the SPP Rules, 2010…….. 11. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA(https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred………… 12. Procuring Agency is required to rectify/justify the above in timely manner………. 13. PA is required to pay web-hosting charges……… It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
