The Procuring Agency has asked PEC category C-4 with specialization codes i-e EE01 – EE02 – EE03 - EE04 - EE06 - EE07 - EE08 - EE09 – EE10, whereas, as per the schedule of requirement, it pertains to Installation and Commissioning of 600 KV Solar Systemt. Therefore, it is transpired that asking the specialization of PEC category in the subject procurement may conflict provision of Rule-44 of SPP Rules, 2010. It may be noted that as per PEC bylaws requirement of PEC category EE01 (Sound System), EE04 & EE06 required for "Low Voltage Installation & Specialized Lighting System" etc….. 2. Procuring Agency has asked bid security 2% of bid price. Whereas, “The Procuring Agency shall require the bidders to furnish a fixed amount of bid security not exceeding five percent of the estimated value of procurement determined by the procuring agency” as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010(5-13/P-II) dated 25.10.2025. Procuring agency is required to rectify the infirmity……… 3. Para-n of the NIT be rephrased as “The Procuring Agency may reject any bid subject to relevant provision of SPP Rules 2010 and may cancel the bidding process at any time prior to acceptance of bid or proposal as per Rule-25(1) of said rules and as per SPPRA rules…… 4. Procuriing Agency has mentioned Procurement Committee constitute in terms of Rule-31. Rectification is required……. 5. Criteria is not clear about requisite list of Key Permanent Technical staff, therefore it required justification that on which grounds most advantageous bidder will be selected as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010 dated 11.08.2021.…….. 6. Procuring Agency is required to rectify/justify the above in timely manner.
