Preliminary Assessment / Observations / Findings:………
1. Criteria is not clear about requisite list of machinery equipment, requisite list of Engineering & technical staff and its bio data, therefore it required justification that on which grounds most advantageous bidder will be selected as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010 dated 11.08.2021.
2. Procuring Agency has mentioned Turn-over “10 millions in each year”. Turnover must be equal as per estimated cost or twice time more than estimated cost required as per rule. Rectification is required……….
3. Procuring Agency has mentioned the evaluation criteria in NIT only. Whereas, in terms of Rule-21(1)(h) read with Rule-21(A), bidding documents must contain a detailed and unambiguous evaluation criteria. The procuring agency is therefore advised to make the evaluation criteria part of the bidding documents. The procuring agency is required to provide a clear and unambiguous evaluation criteria and extend the response time accordingly………..
4. Procuring Agency has asked bid security 5% of quoted bid price. Whereas, “The Procuring Agency shall require the bidders to furnish a fixed amount of bid security not exceeding five percent of the estimated value of procurement determined by the procuring agency” as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010(5-13/P-II) dated 25.10.2025. Procuring agency is required to rectify the infirmity………….
5. Part of B.Ds i.e. BoQ is signed (which is appreciated) but Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-pad) website as defined in the Rule-24 (2) of the SPP Rules, 2010.
6. Procuring Agency has used and posted Standard bidding documents for works Rs. 2.5 to 50 Million instead of Up to Rs. 2.5 millions. Procuring Agency is advised to use standard bidding documents as per estimated cost notified by SPPRA as per Rule-21(3) of SPP Rules.
7. Bid data sheet envisage two different types of contract i.e. Fixed Price contract and Price adjustment contract. The Procuring Agency is required to choose any one.
8. Procuring Agency has asked affidavit that firm have not been blacklisted previously by any executing agency. PA may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition.
9. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA (https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred…………
10. Procuring Agency is required to rectify/justify the above in timely manner……….
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
