Preliminary Assessment / Observations / Findings:………
1. Composition of CRC is not as per Rule-31 as it consist of even number of members instead of Odd number of members. PA is required to re-notify the CRC comprising odd number of members, prior to opening of bids……..
2. In the eligibility criteria PA has mentioned “bidder must provide work order containing SPPRA-ID for verification through the SPPRA portal otherwise, the bid shall be liable to rejection” which is again a discriminatory and difficult condition. PA is required to amend the criteria to allow all bidders having requisite relevant experience, whether in private sector or public/government organizations…….
3. Bid data sheet envisage two different types of contract i.e. Fixed Price contract and Price adjustment contract. The Procuring Agency is required to choose any one…………
4. Procuring Agency has mentioned the evaluation criteria in NIT only. Whereas, in terms of Rule-21(1)(h) read with Rule-21(A), bidding documents must contain a detailed and unambiguous evaluation criteria. The procuring agency is therefore advised to make the evaluation criteria part of the bidding documents. The procuring agency is required to provide a clear and unambiguous evaluation criteria and extend the response time accordingly………..
5. The Procuring Agency has adopted single stage two envelope procedure, but, evaluation criteria consists of only some documentary requirement for 'Single Stage One Envelope'procedure is appropriate. Besides, criteria is not clear about requisite list of machinery equipment, requisite list of Engineering and Technical staff and its eligibility, therefore it required justification that on which grounds most advantageous bidder will be selected as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010 dated 11.08.2021………
6. The Procuring Agency has uploaded a notification of the Complaint Redressal Committee in terms of Rule 31 constituted in 2019 and a notification of the Procurement Committee in terms of Rule 7 constituted in 2022. The procuring Agency has to clarify whether these committees are still functioning with the same members or not. Clarification is required……….
7. Only English & Urdu language newspaper clipping of NIT posted on E-PADs. PA is required to upload newspaper clipping of NIT published in leading dailies of English, Urdu and Sindh languages in terms of Rule-17(1A) & (2) of SPP Rules, 2010………….
8. Procuring Agency has posted unreadable copy of NIT published in English and Urdu language newspapers. PA is required to upload readable / legible copy of newspaper clipping of NIT published in English, Urdu & Sindhi language newspaper’s in terms of Rule-17(2) of SPP Rules, 2010……..
9. Procuring Agency has asked affidavit that the firm has not been black listed previously by any executing agency. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition………..
10. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA(https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred…………
11. Procuring Agency is required to rectify/justify the above in timely manner……….
12. PA is required to pay web-hosting charges………
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
