"(1) The P.A has asked Bid Security in the shape of 'Pay Order' only, which is against the provision of Rule-37 of SPP Rules (read with policy instructions of SPPRA circulated vide letter No:MD/SPPRA/2025-26 dated 11.05.2026) according to which; P.A has to specify all permissible forms of bid security and bidder(s) have their discretion to submit their bid security in any one of form as prescribe in Rule-37(2) of SPP Rules, 2010 2) In terms of Rule-47(1) Single Stage One Envelope bidding procedure shall be used as the standard bidding procedure for procurement of goods, works and services of simple and routine nature and where no technical complexity or innovation is involved. However, in the instant case, which seems to be simple and routine nature, the procuring agency has used single stage two envelope procedure. 3) schedule of Pre-bid meeting envisaged in data sheet as 30.04.2026 i.e. before publication of NIT?!! 4) condition i.e. submission of bid security in favour of account 'Contractor Security of JPMC' as mandatory clause' is conflict with the provision of RUle-44 of SPP Rules 2010" 5) some of cases the bid security required is not less than 1% which is against the provision of Rule-37 6)The procuring agency has included specific country origin/brand name without mentioning the words “Or equivalent”, which is violation of Rule-13(1) of SPP Rules, 2010. Rectification is required. 7)In terms of Rule-13(1) of SPP Rule, 2010, Specifications shall allow the widest possible competition and shall not favour any single contractor or supplier nor put others at a disadvantage. In the instant case P.A has attached specific brand names Broacher at the place of Schedule of Requirement. 8)The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA (https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred. PA is required to rectify/response the above observation with cogent action within stipulated time as per Rules to avoid action under Rule-25
