Preliminary Assessment / Observations /Findings:………
1. NIT is uploaded on E-PADs accordingly the interested bidders are required to submit their bid through the EPAD-System. In the instant case, neither address of E-PAD website is shown in NIT nor procuring agency has mentioned procedure of submission of bid on the E-PAD system, however NIT envisaged that bid will be submitted and opened in the office of Procuring Agency, which is against the standard of electronic bid through E-PADs. Procuring agency is required to rectify the infirmity and extend response time accordingly……….
2. The Procuring agency has not uploaded newspaper clipping of NIT Published in widely circulated leading daily of English, Urdu and Sindhi languages which is violation of Rule-17(1A). Before proceeding further Procuring Agency is required to upload newspaper clipping of NIT on E-PADs in terms of Rule-17(1A) & (2) of SPP Rules, 2010………
3. Procuring Agency has uploaded Notification of Procurement Committee for the year 2025-26 which have been expired. P.A. is required to notify new Procurement Committee for the current financial year in terms of Rule-7 of SPP Rules, 2010……..
4. In terms of Rule-46(1) and as per para 2.16(iv) of guideline of SPPRA for procurement of works; average annual financial turnover not less than equivalent cost of the scheme/project during last five years is required. In the instant case annual turn over is not mentioned……….
5. Procuring agency has mentioned two different minimum time perod for required experience in evaluation eligibility criteria. Procuring agency is required to rectify the infirmities In terms of SPPRA Notification no.DD (HRF&CB)/SPPRA/22-23/0942 dated 10th April, 2023 and extend the response time accordingly………..
6. Procuring Agency has asked bid security 5%. Whereas, “The Procuring Agency shall require the bidders to furnish a fixed amount of bid security not exceeding five percent of the estimated value of procurement determined by the procuring agency” as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010(5-13/P-II) dated 25.10.2025. Procuring agency is required to rectify the infirmity…………
7. Estimated cost, deadline for submission & opening of bids not mentioned in Bid data Sheet in terms of Rule-21(1)(b).
8. Procuring Agency has asked affidavit that the firm is not blacklisted fro any other agency. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition………
9. Part of B.Ds i.e. BoQ and bid data sheet is signed (which is appreciated) but Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-pad) website as defined in the Rule-24 (2) of the SPP Rules, 2010……..
10. NIT consists of 21 works/schemes, Procuring Agency 21 works merge in one file and upload in E-PADS, whereas individual option available at E-PADs therefore it cannot be treated as efficient procurement process……….
11. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA(https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred…………
12. Procuring Agency is required to rectify/justify the above in timely manner……….
13. PA is required to pay web-hosting charges………
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
