Violation Notes
• In terms of Rule-47(1) Single Stage One Envelope, the bidding procedure shall be used as the standard Bidding procedure for the procurement of goods, works, and services of a simple and routine nature and where no technical complexity or innovation is involved. However, in the instant case, which seems to be of a simple and routine nature, the procuring agency has used a single-stage two-envelope procedure. Besides, the evaluation criteria consist of only some documentary requirements, as the 'Single Stage One Envelope' procedure is appropriate. The Procuring Agency is advised to furnish justification for the same.
• The Procuring Agency has not required the mandatory requirement for the evaluation of bids for qualification. Resultantly, bidders who will not provide some mandatory requirement like experience or bank statement, etc, will not get marks eligible for qualification. Rectification is required.
• In terms of para 2.16 (iv) of the guideline of SPPRA for procurement of works circulated vide SPPRA Notification No. DD(HRF&CB)/ SPPRA/22-23/0942 dated 10th April, 2023; according to which relevant experience of similar nature of works ( at least one work of 80% of the estimated cost OR two works of 50% of the estimated cost) executed during the last five years, in the instant case P. A has asked for relevant experience of three years only, but in the instant NIT P. A has not mentioned the time period or the experience of how many years. Rectification is required.
• The criteria must clearly mention minimum requirement e.g. minimum experience (either in terms of years or contracts over a period of time) and minimum amount of turn-over in terms of Rule-46(1)(a). Procuring Agency is required to extend the response time accordingly
• The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA (https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred.
• Part of B.Ds i.e. BoQ is signed (which is appreciated) but Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-pad) website as defined in the Rule-24 (2) of the SPP Rules, 2010.
• The Procuring Agency is required to upload newspaper clippings of the NIT published in at least three widely circulated leading dailies of English, Urdu, and Sindhi languages.
• NIT & Bidding Documents do not show the clear Bidder Qualification requirement, the responsive bidder is based on the minimum managerial capacity, experience of similar projects/assignments, experience of professional persons and financial statement/ annual turnover; then responsiveness shall be decided on Yes/No basis; however when Marks are assigned to each criteria/sub criteria then minimum threshold is to be mentioned in the document/NIT, bidders obtaining score less than threshold shall be treated non-responsive. In the instant case, the Procuring Agency has assigned fixed marks for provision of documentary evidence without mentioning the sub-criteria, which may favor some bidder(s) who failed to provide some mandatory requirement and get passing marks i.e. 70% can easily qualify, as per Rule 21(A) & the guideline of SPPRA for procurement of works circulated vide SPPRA Notification no.DD (HRF&CB) /SPPRA/22-23/0942 dated 10th April, 2023; of SPP Rules 2010.
• As per estimated cost of works, i.e 13 million only, the completion period of 24-months, whereas this work is already in process as per mentioned in NIT, seems too long, justification is required.
