i. Tender fee has been fixed as Rs. 10,000/- which seems excessive because In terms of Rule-20(2), the Procuring Agency is required to ensure that fee charged for bidding document shall not exceed the cost of preparation and printing of the documents. Justification/rectification is required. ii. 5% of quoted amount has been specified as the bid security. However, in accordance with Rule-37(1) of SPP Rules as amended vide notification dated 25.08.2025, the bid security shall be a fixed amount which shall not exceed 5% of estimated cost. P.A is required to rectify the same. iii. As per para 2.16(iv) of SPPRA Regulations for procurement of works circulated vide Notification no.DD (HRF&CB)/SPPRA/22-23/0942 dated 10th April, 2023; relevant experience of similar nature of works (at least one work of 80% of the estimated cost OR two works of 50% of the estimated cost) executed during last five years is required. Whereas, the procuring agency has required experience of three years only, PA is required to rectify the same. iv. Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-pads) website as defined in the Rule-24 (2) of the SPP Rules, 2010. v. The Procuring Agency has asked evidence of ownership of machinery in eligibility criteria, whereas a contractor may obtain such machinery on lease/rent basis for project as per clause-2.16(A) (iii) of Regulation for works, therefore, above condition is in conflict with Rule-44 of the SPP Rules, 2010. Rectification is required. vi. Procuring agency is required to pay NIT Hosting Charges in accordance with this Authority’s letter dated 18.05.2018 in favour of Director (A&F), SPPRA through crossed cheque / Pay Order / Demand Draft. The Procuring Agency is hereby advised to reply to the above mentioned observations/ infirmities.
