Preliminary Assessment / Observations /Findings:………
1. The Procuring Agency has not upload Annual Procurement Plan which is violation of Rule-11 of SPP Rules, 2010. Procuring Agency is required to upload copy of Annual Procurement Plan on E-PADs and extend the response time accordingly……..………
2. In terms of Rule-12 of the Sindh Public Procurement Rules, 2010, the procuring agency shall not split or package a procurement plan with the intention to shorten or facilitate the procurement process and approval mechanism, unless it fulfills the requirement of Rule 12(a), (b) and (c). In the instant case it has been observed that procuring agency has split the same work in parts which is against the provision of Rule-12 of SPP Rules 2010.
3. Procuring Agency has adopted single stage two envelope procedure, but, evaluation criteria consists of only some documentary requirement for 'Single Stage One Envelope'procedure is appropriate. Besides, criteria is not clear about requisite list of machinery equipment, requisite list of technical staff and its eligibility, therefore it required justification that on which grounds most advantageous bidder will be selected……..
4. Procuring Agency has asked bid security 5%. Whereas, “The Procuring Agency shall require the bidders to furnish a fixed amount of bid security not exceeding five percent of the estimated value of procurement determined by the procuring agency” as required under amendment in SPP Rules, 2010 vide SGA&CD Notification No. SORI (SGA&CD)2-30/2010(5-13/P-II) dated 25.10.2025. Procuring agency is required to rectify the infirmity…………
5. Procuring Agency has asked affidavit that the firm has never been blacklisted. P.A may ensure that if a firm was black listed and current status of that firm is De-listed then such firm may be allowed for competition……..
6. Procuring Agency is required to upload signed copy of each and every page of Bid Document to enabling the bidder(s) to submit their bids by downloading Bid Document from SPPRA (E-pads) website as defined in the Rule-24 (2) of the SPP Rules, 2010……………..
7. As per the hard copy of the Notice Inviting Tender (NIT) uploaded by procuring agency (8) works/schemes are mentioned in NIT, whereas, PA has entered (11) schemes/works in detail of items on E-PADs, as per NIT, work No. 01, 2, 3 entered two times in E-PADs with another different name of schemes/works. PA is required to enter details of all works as per NIT, therefore it cannot be treated as an efficient procurement process. Rectification required……..
8. The Procuring Agency shall verify from the list of blacklisted firms available on the website of SPPRA (https://pprasindh.gov.pk/blacklistfirms.php) that the firm/bidder/contractor is not blacklisted or debarred…………
9. PA is required to pay web-hosting charges………
10. Procuring Agency is required to rectify/justify the above in timely manner……….
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit.
