Violation Notes
SUBJECT: EPADS ID NO. 250161414 POSTED ON 30-01-2025.
It is submitted that Office of the Chief Administrator Auqaf Sindh Hyderabad, had posted NIT on EPADS SPPRA website. After examination of said NIT, following observation found:
• The Procuring Agency has not uploaded Annual Procurement Plan as required under Rule-11 of the SPP Rules 2010. PA is required upload APP.
• The procuring agency has not mentioned deadline of submission of Budding Documents as per Rule-17(3)(c) of SPP Rules, 2010
• The procuring agency is required to upload newspaper clipping of NIT Published in widely circulated three leading daily/ies of English, Urdu and Sindhi language(s) in terms of Rule-17(2) of SPP Rules, 2010.
• The procuring agency has not uploaded copy of Notification of Procurement Committee (PC) and Complaint Redressal Committee (CRC). PA is advised to upload the same on SPPRA website.
• The procuring agency has not used/uploaded SPPRA notified standard bidding documents for works which is violation of Rule-21(3) and 21(4) of SPP Rules, 2010.
• The procuring agency has mentioned mandatory requirement for providing affidavit that the company/firm is not in litigation with any public/private sector organization, which is a discriminatory condition. The bidders in litigation may participate in the bidding process until and unless they are not blacklisted / debarred as a result of litigation.
• The procuring agency has stipulated a requirement for experience in similar work amounting to 50% of the estimated cost undertaken within the last three years. However, this requirement is not in accordance with SPPRA Notification No. DD(HRF&CB)/SPPRA/22-23/0942, dated April 10, 2023. As per the notification, the bidder must have completed at least one similar project with a minimum cost of 80% of the estimated cost or at least two projects, each with a minimum cost of 50% of the estimated cost, within the last five years. Accordingly, the procuring agency is required to address and rectify this discrepancy.
• The procuring agency has mentioned required of turnover as 50-million within last three years which is not as per SPPRA notification No. DD(HRF&CB)/SPPRA/22-23/0942, dated April 10, 2023. As per notification, the average annual turn-over not less than equivalent cost of the scheme/project during last five years is required.
• Procuring Agency is required to upload signed copy of bidding documents, enabling bidders to submit their bids by downloading B.Ds from SPPRA website in terms of Rule-24(2) of the SPP Rules, 2010. Prior to opening of bids.
In view of above, it is advised to rectify the above infirmities in timely manner and extend the response time accordingly..
It may be noted that it is the sole responsibility of procuring agency to make all the public procurements by observing the SPP Rules, 2010, regulations, instruction/ orders and procedure in letter and spirit. Violation of any of the SPP Rule/Act/Instruction shall tantamount to Mis-procurement under Rule-32 of SPP Rules, 2010.
